The use and access of this site is provided by Leukaemia CARE subject to the following Terms and Conditions.
1.0 By you using this site you agree to these Terms and Conditions, which falls in to place on the date you first use this website.
2.0 These conditions shall govern the use of this website by you and your purchase of any products to the exclusion of any other terms and conditions.
3.0 Leukaemia CARE may modify these Terms and Conditions at any time. Any such modification will be effective immediately from the time they are included on this website. Any changes will be posted on the site and through continuing to use this website, after such notifications, you are agreeing to the modification within the Terms and Conditions.
4.0 Acceptable use
4.1 No material from this website, including images, logos, information, photographs, names and icons may be copied, republished, posted, duplicated, broadcast or reproduced in any form whatsoever for public use without the prior written permission of the copyright holders.
4.2 You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
4.3 You must not use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
4.4 Documents, posters and leaflets on the site may not be downloaded, altered or adapted for any purpose except for personal, non-commercial use.
4.5 Any organisation wishing to set up a link to the Leukaemia CARE site should send an email to info@leukaemiacare.org.uk with full details. We do not enter into affiliate linking schemes with other websites.
4.6 A link from any organisation's site to the Leukaemia CARE site does not imply that we endorse the activities or views of that organisation.
5. Restricted access
5.1 Access to certain areas of our website is restricted. We reserve the right to restrict access to other areas of our website, or indeed our whole website, at our discretion.
5.2 If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that the user ID and password is kept confidential.
5.3 Leukaemia CARE may disable your user ID and password at our sole discretion without notice or explanation.
6. User generated content
6.1 In these terms of use, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material), that you submit to our website, for whatever purpose.
6.2 You grant to Leukaemia CARE a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to us the right to sub-license these rights, and the right to bring an action for infringement of these rights.
6.3 Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or us or a third party (in each case under any applicable law).
6.4 You must not submit any user content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.
6.5 We reserve the right to edit or remove any material submitted to our website, or stored on our servers, or hosted or published upon our website.
ONLINE SHOP
7. Online Orders
7.1 Leukaemia CARE has the right to refuse to accept any orders placed for products on our online shop.
7.2 You shall be responsible for the accuracy of an order and for giving Leukaemia CARE any information necessary to perform the order. When purchasing online, you will be given opportunity to correct any input errors before you confirm your order to Leukaemia CARE.
7.3 The online order between you and Leukaemia CARE shall come into effect on acceptance of your order, such acceptance to be confirmed in writing by the authorised representative. This will be sent to you by e-mail.
7.4 If you cancel this order for any reason you shall have no further recourse against Leukaemia CARE under this contract.
8. Cancellation
8.1 You may, at your complete discretion cancel the online order within a cooling off period of 7 working days from the day after you receive the products, and receive a full refund of the purchase price provided the products are returned in ”a new” or “as new” condition. Products returned which are not in “a new” or “as new” condition, or products which are returned but the order was not cancelled within the 7 working day cooling off period are dealt with in clause 9 below.
8.2 If you elect to cancel the order, you must serve a notice of cancellation on Leukaemia CARE stating that you wish to end the order. If the day on which Leukaemia CARE is deemed to have received your notice of cancellation is not a normal working day, notice will be deemed to have been given on the next working day.
8.3 If you elect to cancel the order you must, upon receipt of a notice of return, arrange for the products to be returned to Leukaemia CARE within 7 days at your cost. We advise that you return the products by recorded delivery or secure courier as they are your responsibility until they reach us.
8.4 If you fail to return the products in accordance with clause 8.3 above within a reasonable period of time of the notice of return, we may arrange for the products to be collected from your premises.
8.5 You will indemnify Leukaemia CARE against any direct costs and expenses incurred in arranging for the products to be collected in accordance with clause 8.4 above. We may charge your debit/credit card accordingly.
8.6 You agree to keep possession of the products and to take reasonable care of the products for such time as you are in possession of the products for a maximum period of 6 months from the date of the notice of cancellation.
8.7 For the avoidance of doubt, nothing in this clause 8 intended to restrict your right to reject the products for any default of Leukaemia CARE, and to return the products to at our expense in accordance with clause 9 below.
9 Returns
9.1 Leukaemia CARE may at our absolute discretion levy a returns charge of up to a maximum of 30% of the purchase price for any products returned where the order was not cancelled within the 7 day cooling off period under clause 8, or which are not returned in a “a new” or “as new” condition to cover any administration, re-testing, re-packaging and other costs involved in reselling returned products.
9.2 Leukaemia CARE may refuse to accept the return of products which have been returned in a damaged condition. You will, if in our reasonable opinion returned products cannot be economically repaired, repackaged and re-sold, still be liable for the full contract price. This clause does not affect your statutory rights.
10. Substitution of Products
10.1 If Leukaemia CARE are unable to supply the products to you for any reason whatsoever, we may at our sole discretion, supply you with Substitute Products.
10.2 If Leukaemia CARE exercise the right to supply you with Substitute Products, You may cancel the order in accordance with clause 8 above with the exception that Leukaemia CARE will, within 30 days from the cancellation date, reimburse you for the reasonable cost of returning the Substitute Products.
10.3 If you do not exercise your right to cancel the order, this order will continue to have effect as if the Substitute Products were the products that were to be supplied under the order.
11. Delivery
11.1 Dates for delivery are estimates only and are not guaranteed. Time is not of the essence in relation to such dates. They are also subject to any matter beyond Leukaemia CARE's reasonable control.
11.2 Leukaemia CARE will use their reasonable commercial endeavors to ensure delivery on the dates specified.
11.3 Where products are to be delivered in installments, each delivery shall constitute a separate and distinct contract and failure by Leukaemia CARE to deliver, or any claim by you in respect of any installment shall not entitle you to repudiate and/or terminate this order as a whole.
11.4 You shall have no right to reject products and shall have no right to rescind for late delivery unless the due date for delivery has passed and you have served a written notice requiring the order to be performed and giving Leukaemia CARE not less than 14 days in which to do so and the notice has not been complied with.
11.5 We shall not be required to fulfill orders for products in the sequence in which they are placed.
11.6 You shall procure during normal working hours that Leukaemia CARE have free rights of access to the address for delivery for the purpose of delivering the products.
11.7 If you refuse to take delivery of any products then Leukaemia CARE shall be entitled to withhold delivery of any other products and to treat this contract as repudiated by you and shall have the right to rescind the order.
12. Payment
12.1 The price of the products shall be as shown in the current price on the website from time to time.
12.2 You shall pay the monies for any products and/or any other sums payable under the order to Leukaemia CARE at the time and in the manner agreed. Our prices are, unless otherwise stated, exclusive of any applicable VAT for which you shall additionally be liable.
12.3 Payment by you on time under this agreement is an essential condition of the order. Payment shall not be deemed to have been made until Leukaemia CARE have received either cash or cleared funds in respect of the full amount outstanding.
12.4 Payment is to be made by credit/debit card. All online payment transactions are handled by Sage Pay and your card details will not be held by Leukaemia CARE. You will be directed to our credit card merchant’s site in order to input your payment details. Please note that we are not responsible for the security and confidentiality of your data once you leave the Leukaemia CARE Website.
12.5 We have no Liability for any loss and/or damage that you suffer as a result of the credit card merchant’s acts and/or omissions.
13. Specification
13.1 Any specification supplied by Leukaemia CARE to you shall only be approximate unless specifically agreed in writing.
13.2 The quantity, quality, description and/or specification for the products shall be that set out in your order (if accepted by Leukaemia CARE) unless otherwise specifically agreed in writing by the parties.
13.3 You are responsible for checking that the products will fulfill your requirements.
13.4 If there is an error in any specification prepared by Leukaemia CARE then, where that error is material and it has been relied upon by you, you may cancel that part of this order which is affected by the error without liability.
13.5 Details and/or specifications in any brochures, price lists and/or on the website produced by Leukaemia CARE are intended as a guide only and only give a general approximation of the products.
13.6 You confirm and agree that you have not relied upon the details and information contained in our website unless you have sought and obtained written confirmation from Leukaemia CARE of their accuracy.
13.7 We reserve the right to make changes to the specification of the products as required from time to time by law, applicable safety requirements or manufacturing requirements provided that they do not have a material adverse effect on the quality of the Products.
13.8 If Leukaemia CARE do make changes to the specification of the products which have a material adverse effect then you shall have the right to cancel the order without liability.
14. Guarantee
14.1 The guarantee applicable to the products will be described on the Website. Different guarantees may apply for different products. Any guarantee given will be that the products will be free from defects in materials and/or workmanship for the specified period from the date of delivery of the products to you.
14.2 Where the products are covered by another manufacturer’s guarantee, our guarantee will not apply and you should claim under the Manufacturer’s guarantee.
15. Repairs and Replacements
15.1 We will at our option either refund the price, repair or replace free of charge any defective products where the defect is apparent on inspection provided that the defect is notified to us within 15 working days of delivery of such products.
15.2 Any defective products must, where reasonable, be returned to us for inspection if requested by Leukaemia CARE before we will have any liability for such defective products. If the products shall subsequently prove to be defective, then we shall reimburse you for the cost of returning the defective products.
15.3 Leukaemia CARE may at our sole discretion replace, repair free of charge or refund the price of defective products which are not notified to us within the specified time limit where in our opinion the defect would not have been ascertainable on inspection and has been notified to us as soon as reasonably practicable.
16. Use of your Personal Information
16.1 Leukaemia CARE will not collect any personal information about you unless you choose to provide us with it.
16.2 Any personal data processed by Leukaemia CARE will be processed in accordance with any data protection legislation and your instructions and will not be disclosed to any third party without your prior consent. Please see our privacy policy on the website for full details.
16.3 We will use information you provide to us to process your order and to send to you material relating to products in which you have expressed an interest and may send you further material in the future about similar products and services that we believe may be of interest to you. Such material may be sent by post, telephone, fax, email or SMS messaging.
You have a right at any time to prevent Leukaemia CARE from sending marketing material to you.
